Statement on fair enforcement of data protection operations issued by the PCPD

The Office of the Privacy Commissioner for Personal Data (‘PCPD’) released, on 14 November 2018, a statement (‘the Statement’) on the fair enforcement of the Personal Data (Privacy) Ordinance 1997 as amended in 2013 (‘the Ordinance’). In particular, the Statement highlights that compliance checks completed immediately after data breach incidents, are in line with procedural fairness and that the PCPD will assess whether it is in the public interest before publishing compliance investigation reports. In addition, the Statement outlines a list of principles that the PCPD will consider when reviewing the Ordinance, including the purpose and necessity for any legislative restriction, the interests of all stakeholders, as well as the development of information communications technology and the economy.
